Therefore, the spouse who wants to file for divorce should wait 90 days after one spouse has started to live in Illinois or that at the end of the divorce, one of the spouses should have been a resident of Illinois for 90 days.
Attorney Russell Knight mentions that there really is no advantage to filing for divorce before the other party does. The person who files the divorce paper first is labeled “petitioner” and the other party is the “respondent”. These labels are basically the same as the old civil court titles, “plaintiff” and “defendant”.
In the article, the divorce lawyer says that the petitioner is able to file for divorce in either the county they live in or in the county where the other spouse is living. One advantage of filing for divorce first is that if the other party does not file anything in response, the court may find the other party in default and award the petitioner a divorce on their terms.
Furthermore, a default divorce can result in binding decisions regarding child support, maintenance, division of assets, and custody issues. Also, all the parenting time and custody matters are determined by the court and are based on the best interest of the child.
